This Acceptable Use Policy ("AUP") applies to all CivyxIQ LLC products and services, including PermitSleuth, SolarProjeX, SunProjeX, VoltSignalPro, AquaProjeX, PropertyIQ, ViolationRadar, and the civyxiq.com website. By using any CivyxIQ product, you agree to comply with this AUP. Violation of this AUP may result in suspension, termination, removal of content, or legal action.
1. Lawful Use
You must use CivyxIQ products only for lawful purposes and in accordance with all applicable federal, state, and local laws and regulations, including:
- Telephone Consumer Protection Act (TCPA) and related Federal Communications Commission rules.
- CAN-SPAM Act and Federal Trade Commission rules on commercial email.
- State telemarketing laws and Do Not Call registries.
- State and federal data protection and privacy laws.
- Florida and other state laws regulating contractor solicitation, home solicitation sales, and door-to-door sales.
- United States Postal Service requirements for direct mail.
- Anti-discrimination laws, including the Fair Housing Act, Equal Credit Opportunity Act, and similar laws.
2. Prohibited Conduct
You may not use any CivyxIQ product to:
Harmful or Illegal Activity
- Engage in or promote illegal activity, fraud, harassment, threats, stalking, or violence.
- Target individuals based on race, color, national origin, religion, sex, gender identity, sexual orientation, age, disability, familial status, or other protected characteristic.
- Make eligibility decisions about consumers including credit, insurance, employment, housing, or tenant screening. CivyxIQ products are not consumer reports under the Fair Credit Reporting Act.
Marketing and Communications Abuse
- Send unsolicited commercial calls, texts, faxes, or emails in violation of TCPA, CAN-SPAM, or state law.
- Call or text numbers on Do Not Call registries when prohibited.
- Use false caller ID, misleading subject lines, false header information, or deceptive sender identities.
- Send mail or marketing without including required disclosures or opt-out mechanisms.
- Use exported data to impersonate any person, government agency, or business.
Data Misuse
- Resell, redistribute, sublicense, or republish raw exported data to third parties unless you are on a written reseller or agency plan with us.
- Combine exported data with other data sets in ways prohibited by applicable law or by the source data providers.
- Scrape, crawl, or systematically extract data from CivyxIQ products through unauthorized means or in excess of plan limits.
- Use exported data after your subscription has ended in any way that violates this AUP.
Platform Abuse
- Bypass, disable, or attempt to circumvent security features, rate limits, export limits, or access controls.
- Share account credentials with unauthorized users or create multiple accounts to evade limits or fees.
- Reverse engineer, decompile, disassemble, or attempt to derive source code, algorithms, or scoring methodologies.
- Upload malicious code, viruses, worms, or any code intended to harm or disrupt our systems or other users.
- Use automated systems including bots, scrapers, or AI agents to interact with our products in ways that violate plan limits or our published rate limits.
AI and Third-Party Service Misuse
- Submit data to integrated AI services in violation of those services' terms or in violation of applicable law.
- Misrepresent AI-generated content as human-generated when required by law or contract to disclose.
- Use AI features to generate content that is defamatory, deceptive, or designed to manipulate consumers.
3. Public Records and Permit Data
Several CivyxIQ products provide access to data sourced from public government records. You acknowledge:
- Public records may be incomplete, outdated, or inaccurate. We do not warrant the accuracy of source data.
- Permit portals and other public data sources may change format, restrict access, or become unavailable. We are not responsible for portal outages or changes.
- You are solely responsible for verifying records before relying on them for business, legal, or financial decisions.
- Use of public records for marketing must comply with all applicable solicitation laws.
4. Field Operations and Employee Data
Products that collect GPS, photo, timestamp, or other field operations data require you to:
- Provide notice to your employees, contractors, and any other users of the application about what data is collected and how it is used.
- Obtain any consents required by federal, state, or local law before deploying location tracking, photo capture, or biometric features.
- Comply with all applicable wage and hour laws, time tracking laws, and labor regulations.
- Comply with the Illinois Biometric Information Privacy Act (BIPA), Texas Capture or Use of Biometric Identifier Act (CUBI), Washington biometric law, and any other applicable biometric laws.
5. Customer Data and Consent
If you upload customer information into any CivyxIQ product, you represent that you have all necessary rights, permissions, and consents to do so and to allow us to process the data on your behalf.
6. Reporting Abuse
If you believe a user is violating this AUP, contact us at abuse@civyxiq.com. We investigate reports but do not guarantee any specific outcome.
7. Enforcement
Violation of this AUP may result in any combination of the following:
CivyxIQ LLC reserves the right to investigate suspected violations, cooperate with law enforcement, and take any action it deems appropriate.
8. Changes
We may update this AUP from time to time. The updated AUP is effective when posted. Your continued use of any CivyxIQ product constitutes acceptance of the updated AUP.
